Because of punitive
UK OnLine Royalty rates, please note that all music sent to radio2XS
is assumed to be "Free from Worldwide Copyright for radio2XS
airplay", as per these Conditions. As at October 2009, radio2XS
continues to pay royalties to UK Agencies PRS, MCPS and PPL for any
music not covered by this Agreement but this category
will be reduced at quickly as possible.
radio2XS' success is largely due to our enthusiasm for promoting
New Music. All the music we play is unsolicited and we greatly appreciate
the supply of material from record companies, their plugging &
promotion agents, artist management, publishers and artists themselves.
However, all submissions are accepted subject to the following agreement,
no part of which affects copyright ownership in any way:
"By submitting music to radio2XS for airplay consideration,
the owner(s) of the recording(s), the recorded material(s), the original
work(s) and any publisher(s) of such material(s), agree that all such
material(s) are sent to radio2XS on the express condition that they
may be broadcast by us in any or all territories worldwide without
any financial payment by radio2XS to the artist(s) (whether performers,
writers, producers, etc), publisher(s), management, representative
copyright or performing rights bodies, or any other third party."
In return, we undertake not to distribute any works sent to us in
any way other than via our live broadcasts (which, because of the
analogue ouput system we use, cannot be 'ripped'). The only exception
to this are works sometimes available on our On-Demand Radio Player.
In this case, they will be either very short extracts, or low audio
quality, or 'spolied' (by the use of overlayed IDs, etc).
The volume of material we are sent prohibits us from returning
or storing unused material. Music that reaches our playlists is
filed in our extensive CD library but music that we cannot play, for
whatever reason, is kept for a short time and then either destroyed
or forwarded to other possible users. However, any music which is
sent to us on the express condition that it must be available for
later return is subject to a storage charge of £5 ($10) per
week plus mailing costs, payable before return. This charge will ONLY
be made if and when the return is subsequently demanded.
For technical quality reasons, we cannot use digitally compressed
material (MP3s, etc): only 'linear' CD-quality digital recordings
or vinyl, please. We have also found that CDs encoded with 'copy protection'
software sometimes cannot be used as the sound quality is compromised
by unpleasant artefacts when replayed online.
Please note that by sending any music or other materials to radio2XS,
you are expressly agreeing to these terms, which have been in place
since the start of radio2XS in 2002 (and of its predecessors,
the independent radio productions 'XS' and '2XS' since
1998).
